Luxury Rental Homes is a portal that offers services and features that allow travelers to book the properties published on www.luxuryrentalhomes.com and also through mobile applications for mobile phones, tablets and other devices which we will collectively call the “Site”. The registered office of Luxury Rental Homes S.r.l., (hereinafter referred to as “LRH” or “Luxury Rental Homes”), is in Via di San Nicola da Tolentino 45, C.a.p. 00187, Rome.
T&C
These terms and conditions (the “T & Cs”) govern the relationship between Luxury Rental Homes and any person who uses or accesses the Site and any content or service made available therein to travelers or potential travelers who use the Site to access information with regard to properties advertised by LRH and to book such properties on the Site for short-term stays, whether for business or pleasure (“Traveler / s”). By using or accessing the Luxury Rental Homes Website, the Traveler and all the persons indicated in his reservation accept the T & Cs and acknowledge that they are bound by them, as well as by the Privacy Policy and the Cookies Policy of LRH. If Travelers do not fully agree with the T & Cs, with LRH’s Privacy Policy or Cookies Policy, they are not authorized to access the Site or use it in any other way. LRH does not authorize people who are minors or who are legally unable to act to register on the Site. LRH may modify the T & Cs of the Site at any time by publishing an updated version of the same on this web page, therefore Travelers are invited to always consult the most recent and updated version of the T & Cs. The T & Cs establish the conditions of use of the Property rented by the Traveler. For some services, it may be assumed that Travelers and Owners communicate with each other and enter into agreements or other transactions between them. Luxury Rental Homes is not and does not become part of any contractual relationship or agreement between Traveler and Owner and does not act as a mediator between Traveler and Owner in the event of disputes between them. The foregoing also applies if the Site facilitates a reservation for a Property or the use of other tools, services or products, since LRH is not a party to any lease or any other type of agreement between Travelers and Owners.
Real Estate, Ads and related Responsibilities
On the Site, Travelers can view advertisements, obtain information and make reservations regarding properties offered for short-term leasing and for tourist use (respectively “Property / s” and “Ads”) by the owners, tenants and administrators of the same (each of these figure is hereinafter referred to as the “Owner”). The Site offers Property Ads provided to the Site by the Owners or by third party content. LRH does its best to verify the truthfulness and correctness of the content provided at the time of publication of the Property on the Site, however it is possible that some information, photographs and contents are not perfectly updated and correct but the Traveler acknowledges and accepts that LRH does not can be held responsible for such contents. Travelers undertake to comply with laws, rules and regulations relevant to their use of the Site, and any tool, service or product offered on the Site. Travelers take note of the fact that the Owners are responsible and undertake to comply with all the laws, rules and regulations in force in the offer and subsequent leasing of your Property and in the conduct of your commercial real estate leasing activity. Please note that LRH assumes no liability for compliance with any laws or regulations regarding the Properties offered for rent on the Site.
Booking terms and conditions
If a Traveler finds a Property he likes and suits his needs, he can send a booking and information request (the “Request”) by clicking on the appropriate section of the Site specifying the dates of his stay, name and surname of the Travelers, e-mail, telephone number and any additional information requested. Once the Request has been sent successfully, the Traveler will receive an automatic response from LRH confirming receipt of the Request but which does not imply confirmation of the Booking. The Property will be considered booked by the Traveler only following the possible sending of an email by Luxury Rental Homes confirming the price and availability of the Property selected on the dates indicated by the Traveler (the “Request Confirmation”) and which is generally sent, if the Property is available on the dates requested by the Traveler, within 48 hours of the Request. In the event that the Property is not available on the dates selected by the Traveler, LRH reserves the right to propose Properties other than the one selected that have similar characteristics to the unavailable one. Upon receipt of the Request Confirmation, Travelers will be able to make payment for the stay indicated in the Request Confirmation. The total cost of the stay at the Property chosen on the Site (the “Total Cost of the Stay”) consists of (i) the price for the use of the Property (the “Cost of the Stay”), (ii) a commission agency fee equal to 25 euros (the “Agency Commission”), (iii) the amount due for the use of the Site and for the relative assistance (7 days a week) equal to 3% of the Cost of the Stay (the ” Cost of the Service “), (iv) the tourist tax, if due, that each Municipality of Italy applies according to its local regulations (for example, the Municipality of Rome from 1 September 2014 has applied a tourist tax equal to 3 , 50 euros per person per night for a maximum of 10 days, which does not apply to children under the age of 10. For more information on the tourist tax click here) and (v) VAT or any other equivalent indirect tax possibly due (any taxes due will be shown to Travelers at the time of Confirmation of the R requested and will be charged at the time of Booking) (the “Taxes”). The payment of the Total Cost of the Stay can be made online – through the link of the payment service provider selected by LRH – by credit card (Visa, Mastercard, American Express) or PayPal. The online payment service is subject to the terms and conditions of the payment service provider, therefore the Traveler will be required to carefully read these terms and conditions directly on the site of the payment service provider or by following the link on the web page where the Traveler will make the payment. Once the Traveler’s payment has been received, LRH will send a confirmation of the payment and from that moment the reservation of the Property will be considered completed and confirmed (the “Reservation”).
Policy for the Cancellation of the Booking by the Traveler
The Traveler, by making a Reservation through the Site, implicitly accepts the T & Cs for the Cancellation of the Reservation and certifies that he has read and understood the Announcement concerning the Optioned Property and that he deems it suitable for his needs. However, should the Traveler decide to cancel his Reservation within 30 days of the start of the stay, he will be entitled to receive the re-credit of the amount paid for the Reservation – minus the Cost of the Service and the Agency Commission – on the same credit card. used for the Reservation. Should the Traveler decide to cancel his reservation with less than 30 days notice from the start of the stay, he will be entitled to receive the re-credit of the amount paid for the Reservation – minus 30% of the Cost of the Stay, the Cost of the Service and of the Agency Commission – on the same credit card used for the Booking. Should the Traveler decide to cancel his reservation with less than 10 days’ notice from the start of the stay, he or she will be entitled to receive the re-credit of only the tourist tax and taxes.
Cancellation of the Reservation by the Owners and LRH
If due to force majeure the Owners or Luxury Rental Homes are forced to cancel the Reservation, the Traveler will be entitled to use another Property proposed by LRH with similar characteristics to the one not available, it being understood that LRH will do its best, according to availability, to offer a Property with the same characteristics or of a higher level but without an increase in the Total Cost of the Stay. In the event that the alternative proposals are not to the satisfaction of the Traveler, the latter will have the right not to carry out the Check-in and the entire amount paid for the Total Cost of the Stay will be re-credited to the same credit card used by the Traveler to complete the Booking, it being understood that no other responsibility can be attributed to LRH.
Check-in and Check-out
The Traveler must communicate in the Request both his arrival time at the Property and the expected check-out time. Failure to communicate the arrival time by the Traveler will result in the absence of our staff at the time of Check-in, it being understood that the Total Cost of the Stay will still be entirely due by the Traveler to LRH. Unless otherwise agreed, the Check-in time is between 2pm and 7pm. The check-out time, unless otherwise agreed, must be between 9am and 11am. In case of Check-in and Check-out outside the established hours, LRH reserves the right to request a fee between 20.00 and 40.00 euros, depending on the circumstances. In the event of a delay with respect to the scheduled check-in time, the traveler will be required to promptly provide – and in any case at least 3 hours before the scheduled check-in time – the new arrival time at the property. In case of failure to communicate any delays within the aforementioned deadline, as well as in the case of a delay in arrival of more than 90 minutes, LRH reserves the right to request a fee between 20.00 and 40.00 euros, depending on circumstances. This amount can be paid in cash upon Check-in or withdrawn from the same credit card used for the Booking. At the time of Check-in, the keys of the Property will be delivered to the Traveler and must be returned by the Traveler to LRH at the time of Check-out. During the Check-in, the Traveler will have the possibility to inspect the Property and to communicate to LRH (via email or in the eventual report of acceptance of the Property that could be provided by LRH at the end of the Check-in) any, malfunction or breakage found. Failure to arrive by the Traveler on the day of Check-in will mean that the Total Cost of the Stay will still be entirely due by the Traveler to LRH.
Security deposit
The security deposit to be paid for any damage will be quoted to the traveler and made known in the Confirmation of the Request. The amount may vary depending on the type of structure chosen and the length of the stay and must be paid together with the payment of the Total Cost of the Stay. The security deposit, paid by the Traveler to LRH will be fully returned to the Traveler at the time of Check-out, provided that the Property is left in order, and that it is ascertained by LRH staff that no damage has been made to the Property or to the movable property contained therein at the time of Check-in.
Obligations of Travelers in relation to the use of the Site and the Properties
At the time of the Request, Travelers must provide LRH with correct and truthful information about their identity and relating to their stay at the Property. At the time of Check-in, Travelers must provide LRH staff with their passport (in original) in order to allow LRH to fulfill the reporting obligations with the competent authorities imposed by current regulations. The Traveler making the Request will be held responsible for any problem related to the incorrectness and truthfulness of the information provided to LRH, including by way of indication and not exhaustive, those on the number of Travelers who will occupy the Property and in relation to any other communication required by the Site or by current regulations. With reference to the number of Travelers who will occupy the Property, it is specified that the Booking is considered confirmed and guaranteed only and exclusively for the number of people declared in the Request and confirmed in the Confirmation of the Request. The presence of any guests exceeding the number of people declared in the Request and confirmed in the Confirmation of the Request, will give LRH the right to cancel the Booking itself (with the right of LRH to retain all the amount paid in balance of the Total Cost of the Stay, except of the tourist tax). In the event that the number of Travelers is less than the number of people declared in the Request and confirmed in the Confirmation of the Request, LRH will have the right to withhold all the amount paid by the Traveler as a balance of the Total Cost of the Stay. Therefore, the Traveler who makes the Request is recommended to pay the utmost attention when entering the relevant data of the Reservation, it being understood that in the event of an error, the Traveler will still have the right to rectify the number of Travelers within 10 days from the date of Check in. Travelers must use the greatest possible care in using the Property and the immovable property contained therein (which must not be removed from the position in which they are found, damaged or stolen). Travelers must also comply with the condominium regulations regarding the Property (as possibly summarized in the regulations for the use of the Property provided – subject to availability – by LRH at the time of Check-in), public peace, decorum, and the common rules of civility and good education, avoiding shouts, loud noises, behavioral oddities, etc.
Unless specifically authorized in writing by LRH in the Confirmation of the Request or subsequently to the same, Travelers must not communicate directly with the Owners, but only with LRH who will be able to provide the necessary assistance for any information that the Traveler needs in relation to the Property during the entire duration of the stay. In the event that LRH authorizes direct communications between Travelers and Owners, Travelers must in any case refrain from providing the Owner or receiving from him their respective e-mail addresses, social network accounts or telephone numbers.
Rights and obligations of Luxury Rental Homes
LRH will verify as much as possible the authenticity of any photograph provided by the Owner. However, the Traveler acknowledges and accepts that differences may arise between the real condition of the Property compared to that of the photographs published on the Site and that LRH will not be held responsible in any way for any such differences. LRH may occasionally carry out updates and maintenance of the Site and systems. These operations could lead to restrictions on the use of the Site but LRH will try, as far as possible, to minimize the temporary inconvenience. The Traveler acknowledges and accepts that the Site is a virtual showcase in which the Traveler can see the Properties offered for short-term lease, communicate with LRH regarding any requests for information, or to make a reservation for short-term lease. term of a Property. LRH accepts no responsibility for any arrangement the Traveler makes with an Owner and accepts no responsibility for the actions or omissions of any Owner or any other person or party related in any way to the stay at the Property and not directly managed by LRH. LRH is not responsible for any thefts and personal injuries of Travelers within the Properties and other structures published on the Site. In this regard, the Traveler will be responsible for taking out a special travel insurance. LRH does not provide liability insurance coverage for Owners, Real Estate Agents or Travelers. Travelers are advised to take out their own travel insurance that covers the eventuality in which Travelers should cancel the Reservation beyond the terms permitted by the Site. It will be the Traveler’s responsibility to ensure that the insurance stipulated is sufficient and suitable for the specific needs of the Traveler. same. In no event will LRH be liable for any loss of profit, for any direct, consequential, incidental or resulting damage from, based on, or resulting from (i) the Site, (ii) any material or content sent by the Traveler to the Site, ( iii) the use of the Site by the Traveler, (iv) and / or any transaction between the Travelers and the Owners, even if LRH has been notified of the possibility of such damages. If the Traveler does not agree with any part of the T & Cs, the sole and exclusive remedy against LRH is the interruption of the use of the Site, before the Request is made.
Policy for Pets
Pets of any type or size can only be accepted if an express and prior request is made at the time of the Request and only if such presence is permitted by the Property Owners and confirmed by LRH in the Booking Confirmation. LRH reserves the right to consider the Reservation void if the Traveler is accompanied by pets without LRH having given express authorization, and in this case the Traveler must immediately vacate the Property, it being understood that the Total Cost of the Stay will be in any case entirely due to LRH who will do everything possible to accommodate the Traveler in another Property (but only subject to availability and at the discretion of LRH) for which the relative Owner agrees to the presence of pets in the house.
Intellectual Property Rights
All content appearing on the Site is protected by copyright. Reproduction of the Site, in whole or in part, including copying of text, graphics or design, is prohibited, except that Travelers are allowed to download, view or print individual pages of the Site in counter-proof of any agreements with LRH and to keep copy of your Reservation.
Newsletter
By sending the Request, the data provided by the Traveler will be automatically entered in the database of the Site and the Traveler will be able to receive communications regarding offers, services and holiday ideas proposed by LRH, it being understood that the Traveler will have the right to no longer receive such communications and newsletters, by clicking on the following link www.luxuryrentalhomes.com/newsletter/unsubscribe or by making an express request via email to the following email address: info@luxuryrentalhomes.com.
Communications
Any communication addressed to LRH must be sent by e-mail to the following address: info@luxuryrentalhomes.it or to the telephone number indicated in the Booking. Any communication addressed to the Traveler by LRH will be sent to the e-mail address or telephone number provided by the Traveler in the Request.
Applicable law and jurisdiction
These T&C (including documents, conditions, written communications between LRH and the Traveler, or contracts mentioned herein), the Privacy Policy and the Cookies Policy constitute the entire agreement between Luxury Rental Homes and the Traveler for the use of the Site. and of the Property. The invalidity of one or more of the provisions of these T & Cs, the Privacy Policy and the Cookies Policy does not affect the validity of the other provisions. The T & Cs are governed by Italian law and any disputes arising from them are remitted solely to the jurisdiction of the Court of Rome.
